Is my EPA still valid, in England and Wales? | LR Estate Planning

Your EPA is still valid in England and Wales if you signed it before 01 October 2007. If not, you will need to apply for an LPA.

This change from EPA to LPA was made because the government wanted to create a more streamlined system, one which would make it easier for the attorney to act on behalf of the donor. No alterations can be made to an existing EPA, instead it must be replaced with an LPA.

The LPA’s registration process is simpler, eliminating the obligation to inform any relations other than those who are involved as fellow attorneys.

Even if your EPA is valid and legal, we advise you to update it because an NI EPA covers only property and finance, giving no powers where health and welfare are concerned.
